Rubbish Removal Brompton Service Terms and Conditions

These Terms and Conditions set out the basis on which Rubbish Removal Brompton provides rubbish clearance, waste removal and associated services to residential and commercial customers. By booking or using our services, you agree to be bound by these Terms and Conditions. If you do not agree, you must not use our services.

1. Definitions

In these Terms and Conditions:

Company means Rubbish Removal Brompton, the provider of rubbish removal and waste collection services.

Customer means any individual, business, organisation or other party that requests or uses the services of the Company.

Services means any rubbish collection, waste removal, bulky item disposal, garden waste clearance, house or office clearance, or related services provided by the Company.

Waste means any materials, goods, items, refuse, junk, garden waste or other items presented to the Company for removal, excluding items that are prohibited by law or by these Terms and Conditions.

Site means the property, premises or location from which the Company is requested to collect or remove Waste.

2. Scope of Services

The Company provides waste and rubbish removal services for domestic and commercial customers, including but not limited to household waste, garden refuse, furniture, appliances and general junk, subject to applicable waste regulations.

The Company does not undertake the removal of hazardous or specialist waste unless expressly agreed in writing in advance. Prohibited items may include, without limitation, asbestos, clinical waste, chemicals, solvents, gas bottles, pressurised containers, certain electrical items and any substances classified as hazardous under relevant UK legislation.

The Company reserves the right to refuse to remove any Waste which it reasonably believes to be hazardous, unlawful, improperly packaged, unsafe to handle or in breach of waste regulations.

3. Booking Process

3.1 Booking a collection

Customers may request a rubbish removal booking by telephone, email or through any other booking channel operated by the Company. The Customer will be asked to provide details including the Site address, access information, type and approximate volume or weight of Waste, and preferred collection date and time window.

The Company may request photographs or further information to assess the nature and quantity of Waste and the accessibility of the Site. The Customer confirms that all information provided at the time of booking is accurate and complete to the best of their knowledge.

3.2 Estimates and quotes

Any price indication given before the Company attends the Site is an estimate only, based on the description and information provided by the Customer. Final pricing will be confirmed on arrival, once the Company has assessed the Waste and Site conditions in person.

If, on arrival, the volume, weight or nature of the Waste differs from that described, or if access is more difficult than indicated, the Company reserves the right to revise the quotation accordingly. The Customer may accept or decline the revised quotation. If declined, a call-out or cancellation charge may apply as set out in these Terms and Conditions.

3.3 Acceptance of booking

A booking is only confirmed when the Company has accepted the Customer's request and provided a collection date or time window. The Company will use reasonable efforts to meet preferred dates and time slots but does not guarantee availability.

4. Access and Customer Responsibilities

The Customer is responsible for providing safe, reasonable and lawful access to the Site and to the Waste at the agreed time. The Customer must ensure that:

The Company can park its vehicle as close as reasonably possible to the Site or collection point.

Any required permissions for access, parking or loading are obtained in advance.

The Waste is accessible, not concealed, and is located in a manner that allows safe removal.

The Site is safe and does not expose the Company’s employees or contractors to any risk of harm.

If the Company is unable to carry out the Services due to lack of access, health and safety concerns, incorrect information or the Customer's failure to attend, the Company may apply an abortive visit fee or minimum charge.

5. Waste Description and Ownership

The Customer warrants that they are the legal owner of the Waste or that they have full authority from the legal owner to arrange its removal.

The Customer must accurately describe the type and approximate quantity of Waste to be collected. If any items require special handling or disposal under the law, the Customer must disclose this in advance.

Once Waste has been loaded onto the Company’s vehicle and full payment is received, legal title to the Waste passes to the Company, subject to applicable waste and environmental regulations.

6. Payments and Charges

6.1 Pricing

Prices are generally based on the volume, weight, nature of Waste, labour requirements and any additional services requested, such as dismantling of items or extended loading time. A minimum charge may apply to small collections.

6.2 Payment terms

Unless agreed otherwise in advance, payment is due in full at the time the Services are completed and before the Company leaves the Site. The Company may accept cash, debit or credit card payments, bank transfers or other payment methods notified to the Customer.

For commercial accounts with agreed credit terms, invoices are payable within the period stated on the invoice. The Company reserves the right to charge interest and late payment fees on overdue amounts in accordance with applicable UK law.

6.3 Failure to pay

If the Customer fails to make payment when due, the Company may take any lawful steps to recover the outstanding sums, including engaging debt collection agencies or pursuing legal action. The Customer will be responsible for all reasonable costs incurred by the Company in recovering the debt.

7. Cancellations and Rearrangements

7.1 Customer cancellations

The Customer may cancel or rearrange a booking by contacting the Company during normal working hours.

If the Customer cancels with reasonable notice prior to the agreed arrival window, the Company may waive any cancellation fee. If cancellation occurs with short notice or on arrival at the Site, the Company may charge a cancellation fee or minimum call-out charge to cover administrative and travel costs.

7.2 Company cancellations

The Company reserves the right to cancel or reschedule a booking due to circumstances beyond its reasonable control, including but not limited to adverse weather, traffic disruption, vehicle breakdowns, staff illness, safety concerns or compliance with law. In such cases, the Company will use reasonable efforts to notify the Customer and rearrange the collection at a mutually convenient time. The Company will not be liable for any loss or inconvenience arising from such cancellation or delay, save as set out in these Terms and Conditions.

8. Service Performance and Time Windows

The Company will use reasonable skill and care in providing the Services and will make reasonable efforts to attend during any agreed time window. All times are estimates only and are not guaranteed.

The Customer acknowledges that delays can occur due to traffic, weather, operational or safety issues. The Company is not liable for any indirect loss, such as loss of earnings, loss of business, or missed appointments, arising from delayed arrival or rescheduling.

9. Liability and Limitations

9.1 Duty of care

The Company will carry out the Services with reasonable skill, care and diligence, and will take reasonable steps to avoid causing damage to the Site during normal rubbish removal activities.

9.2 Damage to property

The Customer must advise the Company of any fragile areas, hidden services, vulnerable surfaces, restricted access points or other features that may be at risk of damage during loading or movement of Waste.

The Company is not liable for any damage caused where:

The Customer insisted on the Company moving items through tight, restricted or unsafe spaces, or over surfaces not suitable for heavy loads.

The damage arises from pre-existing defects, wear and tear or structural weaknesses at the Site.

The damage is minor and incidental to the normal performance of rubbish removal work.

Where the Company is found liable for damage, its liability will be limited to the reasonable cost of repair or, where repair is not practical, the replacement cost of the damaged item or area, subject to fair wear and tear and depreciation.

9.3 Exclusions of liability

To the fullest extent permitted by law, the Company is not liable for:

Any indirect or consequential loss, including loss of profit, business, reputation or opportunity.

Any loss or damage that was not reasonably foreseeable at the time of entering into the contract.

Any loss arising from the Customer's failure to comply with these Terms and Conditions.

Nothing in these Terms and Conditions excludes or limits the Company's liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded under UK law.

10. Waste Regulations and Environmental Compliance

The Company operates in accordance with applicable UK waste management, environmental and duty of care legislation. Waste collected by the Company will be transported and disposed of or recycled at authorised facilities in compliance with relevant regulations.

The Customer agrees not to present for collection any Waste that is unlawful to transport, handle or dispose of through standard commercial waste channels. The Customer will indemnify the Company against any fines, penalties, claims or costs arising from the inclusion of prohibited, hazardous or undisclosed items in the Waste.

Where practicable, the Company will seek to divert Waste from landfill by prioritising reuse and recycling, but makes no guarantee as to the exact proportion of Waste that will be recycled or reused.

11. Customer Conduct

The Customer must treat the Company’s staff and contractors with courtesy and respect at all times. The Company may suspend or terminate the provision of Services if its staff are subjected to abuse, threats or unsafe behaviour at the Site.

12. Complaints

Any complaints about the Services should be raised with the Company as soon as reasonably possible, providing full details and any supporting evidence. The Company will investigate complaints and aim to respond within a reasonable timeframe.

If the Customer fails to notify the Company of any issue within a reasonable period after the Services have been provided, it may be more difficult for the Company to investigate and resolve the matter.

13. Force Majeure

The Company is not liable for any delay or failure to perform its obligations where such delay or failure results from events, circumstances or causes beyond its reasonable control, including but not limited to extreme weather, fire, flood, industrial disputes, civil unrest, public health events, road closures or failure of utilities.

14. Data Protection and Privacy

The Company may collect and process personal information about Customers for the purposes of managing bookings, providing Services, processing payments, handling enquiries and complying with legal obligations. The Company will handle such information in accordance with applicable UK data protection laws.

15. Variation of Terms

The Company reserves the right to amend or update these Terms and Conditions from time to time. The version in force at the time of the Customer's booking will apply to that booking. Updated terms may be provided to the Customer or made available upon request.

16. Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or competent authority, that provision shall be deemed deleted, but the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms and Conditions, together with any written quotation or confirmation issued by the Company, constitute the entire agreement between the Company and the Customer in relation to the Services and supersede any prior discussions or understandings.

18. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, are governed by and construed in accordance with the laws of England and Wales.

The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, the Services or their subject matter.

By placing a booking or allowing the Company to commence the removal of Waste, the Customer confirms that they have read, understood and agree to these Terms and Conditions.
